Terms of service
Last updated: 18 October 2026
1. Who we are
Gild & Grain is a trading name of G IT Consulting (Pty) Ltd, registration number 2013/015920/07, of 5 Sycamore Street, Fairie Knowe, Cape Town, 7975, South Africa (“we”, “us”, “our”). These terms govern your use of our website www.gildandgrain.co.za and your purchase of goods from us.
2. These terms
By browsing our website or placing an order, you agree to these terms, together with our Shipping Policy, Refunds & Returns Policy and Privacy Policy. Please read them before you order. If you do not agree, please do not order.
We may update these terms from time to time. The version published on this page when you place your order is the version that applies to that order.
3. Eligibility
You must be at least 18 years old, or have the consent of your parent or guardian, to place an order.
4. Our products
Every Gild & Grain piece is handcrafted in our Cape Town studio from genuine leather. Because leather is a natural material and each item is made by hand, colour, grain, markings, stitching and finish may vary slightly from item to item and from the photographs on our website. These variations are inherent in handmade leather goods and are not defects. We make every effort to display colours and textures accurately, but we cannot guarantee that your screen shows them exactly as they are.
5. Prices and currency
All prices are in South African Rand (ZAR) and are inclusive of any applicable taxes. Shipping is charged separately and is shown at checkout. We may change prices at any time, but a change will not affect an order we have already accepted.
If you pay in another currency, the amount you are charged may differ from the listed price because of exchange rates and bank or card fees. We are not responsible for those differences.
6. Orders and acceptance
An order is an offer to buy. We accept your order when we confirm dispatch. We may decline or cancel an order, including where the item is out of stock, where a price was listed in error, or where we suspect fraud, and we will refund any amount already paid.
7. Payment
Payment must be made in full at checkout. We use third-party payment providers; we do not store your full card details.
8. Delivery, returns and refunds
Delivery is governed by our Shipping Policy. Returns and refunds are governed by our Refunds & Returns Policy. Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.
9. Personalisation
Personalised and made-to-order items are produced to the details you supply. Please check names, initials and spelling carefully before you confirm your order; personalised items cannot be returned for a change of mind or for an error in the details you supplied.
10. Intellectual property
All content on this website – text, photographs, logos, product names and designs – belongs to us or our licensors and is protected by copyright and trade mark law. You may not copy, reproduce, or use it for commercial purposes without our written permission.
11. Your account
If you create an account, keep your password confidential, use accurate details, and tell us immediately about any unauthorised use. We may disable an account if these terms are breached.
12. Acceptable use
You may not use our website to:
- break any law;
- infringe anyone’s rights;
- interfere with, damage, or gain unauthorised access to the website or its security;
- scrape or harvest data;
- send spam;
- post unlawful, defamatory, hateful, or obscene material.
13. Reviews and user content
If you submit a review, comment or other content, it must be your own, accurate and lawful. By submitting it you give us permission to display it on our website and in our marketing. We may remove content at our discretion. We do not edit the substance of genuine reviews.
14. Third-party links
Our website may link to third-party websites, including stockists and partners. We do not control those websites and are not responsible for their content, products or policies. Your dealings with a third party are between you and that third party.
15. Disclaimer
We take care to keep the information on our website accurate, but we do not warrant that it is free of errors or always available. This clause does not exclude or limit any right you have under the CPA or ECTA, or any warranty that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss of data arising from your use of our website. Our total liability for any order is limited to the amount you paid for the goods in that order. This clause does not limit liability that cannot lawfully be limited, including under the CPA.
17. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms or your misuse of our website.
18. Privacy
We process your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and our Privacy Policy.
19. Electronic communications and marketing
By placing an order you consent to receive order-related communications electronically. We will only send you marketing communications if you have opted in, and every marketing message will let you unsubscribe. Visiting our website and emailing us are electronic communications; you agree that agreements and notices we send you electronically satisfy any legal requirement that they be in writing.
20. Force majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including load-shedding, courier delays, strikes, natural disasters, or failures of suppliers or infrastructure.
21. Changes to these terms
We may update these terms at any time by publishing the new version on this page. Continued use of our website after an update means you accept the updated terms.
22. Governing law and jurisdiction
These terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts. This does not deprive you of the protection of any mandatory consumer law in your country of residence.
23. Disputes
If you have a complaint, email info@gildandgrain.co.za. We will try to resolve it with you in good faith. If we cannot, you may refer the matter to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission. Nothing in this clause prevents either of us from approaching a court.
24. Severability
If any part of these terms is found to be unenforceable, the rest remains in force.
